Payments

  • Invoices:Payment terms are outlined in your invoice or service agreement. Prompt payment ensures smooth project delivery.
  • Deposits: Some projects may require an upfront deposit before work begins.
  • Refunds: Payments are non-refundable once work has commenced, except in cases where Ecomfly is unable to deliver services due to reasons within our control.
  • Late Payments: Delays in payment may result in paused services or additional fees.

Intellectual Property

  • Ownership: Until full payment is received, all work we create (designs, code, etc.) remains the property of Ecomfly. Once payment is complete, you’ll own the rights to the custom solutions provided.
  • Portfolio Use: We may showcase elements of your project in our portfolio or marketing materials unless you request otherwise.
  • Restrictions: You’re not allowed to resell or redistribute our work without prior permission.

Privacy

  • Your Data:We respect your privacy. Any information you share with us, including business details and project data, will remain confidential.
  • Third-Party Sharing:We only share your information when necessary to complete your project or comply with legal obligations. We never sell your data.

Changes to Projects

  • Scope Changes:If you need to change the scope of a project, let us know. We’ll provide an updated estimate and timeline.
  • Delays: Timely feedback and approvals are crucial. Delays on your end may impact the project timeline and costs.
  • Cancellations: If you cancel before we begin work, there’s no charge. If work has started, you’ll be billed for the portion completed.

Refund Policy

Refunds MAY be approved if:

  • You reject the initial deliverable without requesting revisions.
  • You cancel before any work is started (admin fees apply)
  • We cannot complete your project due to internal reasons.

Refunds WILL NOT be approved if:

  • Discounted or promotional package was purchased.
  • Initial or revised designs were approved.
  • You requested revisions or became inactive.
  • You changed your mind or business model.
  • Final deliverables were approved or delivered.
  • Third-party services (SEO, hosting, domain registration, etc.) were involved.
  • Scope changed massively without a new agreement.

Special Notes:

  • Bundles: Refunds only apply to the unsatisfactory service, not the entire package.
  • Initial or revised designs were approved.
  • Post-Refund Ownership: After a refund, The Ecomfly retains full ownership of any deliverables. You can’t use anything we made.

Requesting a Refund:

  • To request a refund, email letstalk@Ecomfly.us with your project ID and reason. We’ll respond in 5–7 business days.

Your Responsibilities

  • Accuracy: Provide clear and accurate information about your business, goals, and requirements.
  • Compliance: Ensure that all content or data you provide complies with applicable laws and doesn’t infringe on any third-party rights
  • Usage: Use the solutions we provide responsibly and only for their intended purpose.

Third-Party Tools and Platforms

  • Integrations: We integrate third-party platforms like Shopify, Amazon, or payment gateways into your project.
  • Liability: We’re not responsible for the performance, pricing changes, or outages of third-party platforms.
  • Terms: You’re responsible for adhering to the terms of any third-party tools or platforms we integrate.

Warranties and Limitations

  • Our Commitment: We promise to deliver services professionally and as agreed in your contract.
  • No Guarantees: While we aim for success, we can’t guarantee specific results like increased sales or web traffic.
  • Liability: Ecomfly isn’t liable for indirect, incidental, or consequential damages, such as lost revenue, arising from the use of our services.
  • Limits: Our total liability is capped at the amount you’ve paid us for the specific service in question.

Service Interruptions

  • External Factors: We’re not responsible for delays or interruptions caused by factors outside our control, like platform outages or third-party issues.
  • Communication: If issues arise, we’ll notify you promptly and work to resolve them.

Disputes

  • Resolution: If a dispute arises, we encourage open communication to resolve it amicably.

Delivery Method / Shipping Policy

All deliverables are sent digitally and/or electronically . We operate strictly on a milestone-based delivery system, meaning each stage of the project is completed and delivered as agreed upon in the project scope or contract. Once a milestone is approved, the corresponding deliverables are shared via email or any preferred communication channel mutually agreed upon between The Ecomfly and the client. We do not offer any physical shipping or printed deliveries. All files, assets, or materials are transferred electronically. It is the client’s responsibility to ensure that their provided communication channels (e.g., email address, Slack, Trello, etc.) are active and accessible throughout the duration of the project. Once a deliverable is sent, The Com Cube will consider that milestone fulfilled unless the client raises a concern or revision request as per the agreed revision policy.
